Oppenhoff & Partner advises RWE on joint venture with a holding company of 26 public utility companies from NRW and Lower Saxony
Press Release 7 April 2010
Oppenhoff & Partner has advised RWE Innogy GmbH on a cooperation with 26 public utilities to produce electricity and heat from renewable energies. Together with these 26 public utilities it has established the company Green Gecco GmbH & Co. KG, which presently represents a unique collaboration between energy supplier and public utilities. By 2020, about one billion euro is to be invested in German and European projects to expand the areas wind power, biomass, geothermal energy, biogas, water power and solar heat. The public utilities hold a 49% interest in the joint venture and RWE a 51% interest. The first project of the new company will be the offshore park “An Suidhe” in Northern Scotland. The wind park is already under construction and should go into operation next year with a capacity of 20 megawatts. 23 turbines at the park will then produce electricity for about 14,000 households.
An Oppenhoff & Partner team, led by Dr. Lars Böttcher (corporate law), extensively advised RWE Innogy on this joint venture. Further team members were Henning Fischer (energy law), Stephan Müller, Holger Hofmann (public procurement law) and Dr. Maxim Kleine (antitrust law). The legal advisor of the holding company of the public utilities was Clifford Chance.
